Rule 4
Ranks and Posts
(1) At the time of commencement of this regulation, the employees who are currently in the Raj Prasad Service will be considered to be in the special group of the Nepal Various Services by remaining in the same rank and position as they are.
(1a) The employees who are in the position of Assistant Secretary of Gazetted Second Class or similar post at the time of commencement of this bye-law shall automatically be appointed as Assistant Secretary of Second Class Gazetted or similar post after the commencement of this rule. 1b) For the purpose of calculating seniority points when promoted to a gazetted first class post by performance evaluation, the period of working as a gazetted second class assistant secretary or similar post will also be counted.
(1c) Employees who are in the following categories or equivalent positions at the time of commencement of this sub-rule shall be deemed to have been retained in the following categories and positions after the commencement of this sub-rule –
(a) Employees working in Gazetted First Class or equivalent posts in Gazetted First Class Joint Secretary posts,
(b) an employee working in the gazetted second class or equivalent post in the post of deputy secretary in the gazetted second class,
(c) Employees working in gazetted third grade or equivalent posts in gazetted third grade branch officer posts,
(d) Employees working in Gazetted First Class or equivalent posts in the Gazetted First Class Naiva Subba post,
(e) Employees employed in gazetted second class or equivalent posts in the gazetted second class buyer post.
(f) Employees working in gazetted third grade or equivalent posts in the gazetted third grade head post. However, within sixty days from the date of commencement of this rule, the employees who have designations as per schedule 3, clauses (e) and (f) and currently working in the position of Bahidar or the like, may be retained in unranked positions voluntarily, or if they apply to the Ministry, such employees can be retained in unranked positions.
(1d) SubAccording to Clause (1c), if an employee's salary is lower than the salary scale when he is retained in a non-graded position, the salary scale will be adjusted as follows so that the salary salary does not decrease in the benefits -
(a) According to the salary scale of the corresponding level as per sub-section (1) of section 24D2 of the Act, (b) Even when matching according to clause (a), if the salary received is less than the facility, according to the salary scale of the matching category according to section 4 of the Act.
(1e.) According to sub-rule (1d.), the increase in salary of the employee whose salary scale is matched shall be based on the increase in the salary scale that was established when the salary scale was matched.
(1f.) In accordance with section 38 of the Act of the retired unranked employee whose salary has been adjusted according to sub-rule (1d), the increase in pension will be based on the increase in the salary that was maintained at the time of the salary adjustment. (2) However, the person appointed after the 4th of Jeshta, Samvat 2063 will not remain in the group.
(3) Notwithstanding anything written in sub-rule (1), after the commencement of this sub-rule, the posts of various categories in the group shall be as per Schedule-4.
